The rules that govern your use of Mailers.io. Plain-ish English, because nobody benefits from legalese.

1. Agreement
These Terms of Service ("Terms") govern your use of Mailers.io ("Service") provided by Mailers.io, Inc. ("Company", "we", "us"). By creating an account, using the Service, or connecting a sending provider through the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. What the Service does
Mailers.io is an email orchestration layer. You connect your own sending providers (ESPs or SMTP servers). We route, schedule, and report on sends across them. We do not generate sending reputation, do not resell sending volume, and do not manage inboxes or replies.
3. Accounts & workspaces
You are responsible for the accuracy of account information, the security of login credentials, and the activity that occurs under your account. Workspaces may be shared with teammates and sub-accounts you create. You are responsible for actions taken by users you grant access to.
4. Bring-your-own-providers
The Service routes sends through sending providers you connect. You are responsible for your contracts with those providers, compliance with their acceptable use policies, and all sending volume costs billed by them. We only store provider credentials as required to operate the Service.
5. Acceptable use
You must not use the Service to send unsolicited bulk email that violates applicable law, to send content that is illegal, fraudulent, deceptive, or harmful, or to evade unsubscribe requests or suppression enforcement. We may throttle, suspend, or terminate accounts that appear to abuse the Service or that materially harm the reputation of other customers.
6. Your content & data
You retain ownership of subscriber data, templates, and content you upload. You grant us a limited licence to process it solely to operate the Service on your behalf. You are responsible for the lawful basis to send to your recipients, unsubscribe handling, and the accuracy of content.
7. Fees & billing
Service fees are based on the plan you select. Fees are billed in advance and are non-refundable except where required by law. We may change pricing with reasonable notice for renewal periods. Fees charged by your sending providers are separate and billed directly by them.
8. Service availability
We aim to keep the Service available and monitor status publicly. We do not guarantee uninterrupted availability. Scheduled maintenance, provider-side outages, and force-majeure events may affect the Service.
9. No deliverability guarantee
Deliverability depends on factors outside our control: sending domain reputation, content, recipient behaviour, and receiving-side decisions made by mailbox providers. We provide tools to improve deliverability but do not guarantee inbox placement, open rates, or delivery rates.
10. Intellectual property
The Service, including its software, design, and documentation, is owned by the Company and protected by applicable IP laws. These Terms do not grant you rights in our IP beyond the right to use the Service as permitted.
11. Confidentiality
Both parties will protect each other's confidential information with reasonable care and use it only to perform under these Terms.
12. Termination
You may cancel your account at any time. We may suspend or terminate accounts for breach of these Terms, non-payment, or abuse. On termination, you remain responsible for outstanding fees and we will provide a reasonable export window for your data.
13. Limitation of liability
To the maximum extent permitted by law, the Company's aggregate liability for claims arising under these Terms is limited to the fees you paid for the Service in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
14. Indemnity
You agree to indemnify the Company for third-party claims arising from your content, your use of the Service, or your violation of these Terms.
15. Governing law
These Terms are governed by the laws of the jurisdiction in which the Company is registered. Disputes will be resolved in the competent courts of that jurisdiction, without prejudice to mandatory consumer rights.
16. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use after changes take effect constitutes acceptance of the updated Terms.
